Terms of Service
These terms are a plain-English agreement between you and Gawkin ("we", "us") covering the Gawkin website (gawkin.app) and the Gawkin iPhone app (together, the "Service"). By playing, you agree to them. If you don't agree, don't use the Service.
1. Who can play
You must be at least 13 years old (or the minimum digital-consent age in your region, if higher) to use the Service. If you're under 18, you should have a parent or guardian's permission.
2. Your account
You can play on the web without an account. If you create one (email, Google, or Apple sign-in), keep your credentials safe — you're responsible for activity on your account. Display names are public; don't impersonate anyone. We may reclaim names that are offensive or misleading.
3. Live video and conduct
Gawkin is a live, face-to-face game. When you enter a match, your camera and microphone are streamed to your opponent — and, if the match is being spectated or the room is public, to viewers. You must follow the Community Guidelines: no nudity or sexual content, no harassment or hate, no violence, no illegal activity, and no involving minors. We may suspend or permanently ban accounts and devices that break these rules, without notice for severe violations.
4. Fair play
Blink detection runs on each player's own device. Attempting to defeat it — modified clients, scripts, covering or replacing your camera feed, or any other manipulation of results, leaderboards, or matchmaking — is cheating and grounds for removal from the Service.
5. Gems and purchases
- Gems are a virtual in-game currency. They have no cash value, can never be converted to money, and cannot be transferred outside the Service. Sending gems to another player ("tipping") is final.
- Purchases are processed by Apple (in the iPhone app) or Stripe (on the website). Prices are shown before you buy. Except where the law requires otherwise, purchases of gems and subscriptions are non-refundable; for App Store purchases, refunds are handled by Apple under their policies.
- Gawkin Pro is an auto-renewing subscription; you can cancel any time and keep access until the end of the paid period.
- We may change gem pricing, availability, or features of the virtual economy. If we ever discontinue the Service, unused gems expire with it.
6. Our content, your content
The Service — its code, design, mascot, names, and artwork — belongs to us; we grant you a personal, non-transferable licence to use it to play. Anything you transmit through the Service (your video, chat messages, display name) remains yours; you grant us only the limited rights needed to operate the Service (for example, relaying your live video to your opponent). We don't record your matches on our servers.
7. Availability
Gawkin is provided "as is." We work hard to keep it up, but we don't guarantee uninterrupted service, that matchmaking always finds an opponent, or that blink detection is perfect on every camera and lighting setup. We may change, suspend, or discontinue features at any time.
8. Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential losses arising from your use of the Service, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms excludes liability that cannot legally be excluded.
9. Termination
You can stop using Gawkin or delete your account at any time. We may suspend or terminate access for breach of these terms or the Community Guidelines.
10. Changes to these terms
If we make material changes, we'll update the date above and, where practical, give notice in the Service. Continuing to play after changes take effect means you accept them.
11. Governing law
These terms are governed by the laws of Ireland, and disputes belong to the courts of Ireland — though we'd much rather you just email us first.
